This Privacy Policy, along with other policies available on eof.gg, applies to your use of Engines of Fury's Services (as defined in our General Terms available here) whether or not access is achieved through eof.gg or third parties (such as Epic Games Store) or by directly interacting with Engines of Fury smart contracts. Where we refer to "Engines of Fury", "us", "we" or "our" in this Policy, we are referring to Prosperity Joint Limited (Data Representative), a Hong Kong-based company at Unit A, 3/F, Cheong Sun Tower, 116-118, Wing Lok Street, Sheung Wan, Hong Kong, who oversees the effective maintenance of this Policy and who manages Customer Data in accordance with the terms of this Privacy Policy. Defined terms used in this Privacy Policy are defined in our General Terms, unless an alternative definition is expressly specified in this Privacy Policy.
Introduction
We are committed to operating with the highest level of integrity and respecting your privacy. This Privacy Policy, as may be amended by us from time to time, sets out the details relating to your data relationship with Prosperity Joint Limited, Engines of Fury's Data Representative. We comply with the Personal Data (Privacy) Ordinance (PDPO) and its 6 Data Protection Principles: (1) Purpose and manner of collection (limited/necessary, e.g., only for gameplay); (2) Accuracy and duration (keep accurate/retain only as needed, e.g., 6 months post-inactivity); (3) Use limitation (only for consented purposes); (4) Security (protect against loss/unauthorized access); (5) Openness (transparent policies); (6) Access and correction (user rights to view/amend). Your access to and use of the Services and the Interface are conditioned on your acceptance of and compliance with this Privacy Policy. By providing Personal Information to us, you consent to our collection, use, and disclosure of your Personal Information in accordance with this Privacy Policy and any other arrangements that apply between us. We may change our Privacy Policy from time to time by publishing changes to it on our website. We encourage you to check our website periodically to ensure that you understand our current Privacy Policy.
What Personal Information do we collect?
Personal Information includes information or an opinion about an individual that is reasonably identifiable. For example, this may include your name, age, gender, postcode, and contact details. It may also include financial information, including your credit card information. The categories of Personal Information we may collect and process depends upon the nature of your dealings with us and may include:
- Personal details: name; gender, date of birth, nationality;
- Contact details: email address; address, mobile number, social media account;
- Interaction details: activity details of your interactions with Engines of Fury including products purchased, Services used, activity details of related purchases, preferences, interactions;
- Technical information: your device ID, device type, geo-location, computer and connection information, statistics on page views, traffic to and from our websites, ad data, IP addresses and web log information;
- Blockchain transactions: any bids, offers, buys, sells, transfers (including involving staking and liquidity provision), fees, withdrawals, claims, mints, burns, or other like interactions associated with your IP address, your public wallet address or other public address (only if you opt to connect a wallet like Immutable Passport , with risks of hacks or volatility disclosed);
- Customer support: details of the Services we have provided to you or that you have enquired about, including any additional information necessary to deliver those Services and respond to your enquiries; and
- Feedback information: information you provide to us through surveys.
How do we collect Personal Information?
We may collect Personal Information about you when you:
- Access our Services including visit our Interface, download a game, register for an Account or make a purchase or place an order for our digital or physical goods or Services;
- Communicate with us through correspondence, chats, email, or when you share information with us from other social applications, Services or websites;
- Make enquiries, report suspicious market activity or submit comments, bug reports, ideas, or other feedback about the Interface and our Services;
- Connect your compatible wallet (e.g., Immutable Passport) to the Engines of Fury Interface, sign a blockchain transaction or otherwise interact with the suite of smart contracts that comprise the Engines of Fury protocol from time to time (only if you opt-in);
- Interact with our Interface, Services, content and advertising; or join a mailing list;
- Participate in a competition, promotion or survey;
- Post a review, rating, comment, or other user-generated content on one of our websites or applications; and
- We may also collect Personal Information when we receive your Personal Information from third parties who legally provide it to us (including further to recruitment activities, or from Epic Games Store for access data).
Why do we collect, use and disclose Personal Information?
We may use your Personal Information to:
- Enable you to access and use our Services;
- Operate, protect, improve and optimize our Interface and Services, and our users' experience, such as to perform analytics, conduct research and for advertising and marketing;
- Send you service, support and administrative messages, reminders, technical notices, updates, security alerts, and information requested by you;
- Send you marketing and promotional messages and other information that may be of interest to you, including information sent by, or on behalf of, our business partners that we think you may find interesting;
- Administer surveys, contests, or other promotional activities or events sponsored or managed by us or our business partners;
- Comply with our legal obligations, resolve any disputes that we may have with any of our users, enforce our terms and other agreements, or to protect the rights, property or safety of Engines of Fury participants or others;
- Consider your employment or other application; and
- For any other purpose with your consent.
Disclosure of Personal Information
We may disclose Personal Information for the purposes described in this Privacy Policy to:
- Our personnel and related bodies corporate and their personnel;
- Third party suppliers and third party service providers, including providers for the operation of our business or in connection with providing our Services to you;
- Professional advisers, dealers and agents;
- Our existing or potential agents, business partners or partners;
- Our sponsors or promoters of any competition that we conduct via our Services;
- Anyone to whom our assets or businesses (or any part of them) are transferred;
- Specific third parties authorized by you to receive information held by us; and/or
- Other persons, including government agencies, regulatory bodies and law enforcement agencies, or as required, authorized or permitted by law.
International transfer of Personal Information
We may disclose Personal Information outside of your country of residence to third party suppliers and cloud providers located outside the EU/EEA. We are responsible for putting in place suitable technical, organizational and contractual safeguards to ensure that any transfer is carried out in compliance with applicable data protection rules, except where the country to which the data is transferred has already been determined by the European Commission to provide an adequate level of protection.
For transfers to Mainland China or other non-adequate jurisdictions, we use standard contractual clauses and conduct risk assessments per PDPO.
Security
We are responsible for designing systems with your security and privacy in mind. We may hold your Personal Information in either electronic or hard copy form. We take reasonable steps to protect your Personal Information from misuse, interference, and loss, as well as unauthorized access, modification, or disclosure. Due to the emerging and uncertain nature of blockchain technology, the appointment of the Data Representative to own and control the data collected is a necessary step to prevent unauthorized access to your Personal Information. In case of breaches, we notify affected users and the Privacy Commissioner as required by PDPO. You are responsible for safeguarding the password that you use to access the Services, whether your password is supplied to us or to a Third-Party Service provider, who in turn supplies it to us. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your Account.
Direct Marketing
We and/or our carefully selected business partners may send you direct marketing communications and information about our Services. This may take the form of emails, SMS, mail, or other forms of communication. You may opt-out of receiving marketing materials by contacting us using the details below or the opt-out facilities provided (e.g., an unsubscribe link).
Your Rights
Subject to Applicable Laws, you are entitled to the following rights:
- Right to access - you have the right to obtain confirmation that your Personal Information is processed and obtain a copy of it as well as specific information related to its processing.
- Right to rectify - you can request the rectification of Personal Information that is inaccurate or add to it.
- Right to delete - you can, in some cases, have your Personal Information deleted.
- Right to object - you can object, for reasons relating to your circumstances, to the processing of your Personal Information.
- Right to limit processing In certain circumstances, you have the right to limit the processing of your Personal Information.
- Right to portability - you can request to receive your Personal Information in a structured, commonly used, and machine-readable format, or, when this is possible, that we communicate your Personal Information on your behalf directly to another data controller.
- Right to withdraw your consent For processing requiring your consent, you have the right to withdraw your consent at any time; however, exercising this right does not affect the lawfulness of any processing based on your prior consent.
- Right to set instructions relating to the use of your Personal Data post mortem - you have the right to define instructions relating to the retention, deletion, and communication of your Personal Information after your death.
